Dam is tri coloured pinto and sire is b/w homozygeous for tobiano.

I wonder if I should call the colour "smoky black"?

Her foal last year is the pinto shown below. Not really black and white, but I am not sure what to call her colour.

Yes, "Smokey Black" is a correct color. It is Black plus the Cream gene. It MAY discolor the Black somewhat, but will often not show at all. Silver Black is Black plus the Silver gene, which usually gives it a "smokey" appearance, but it is not genetically "Smokey Black".
