Black hairs on a chesnut pinto?

Not the best photo as it doesn't show how dark these hairs really are.

There are lots more black hairs in his tail than the little section I placed on his rump for contrast.

As an artist I have a pretty good eye in regards to color and these peppered through tail hairs are black.. they don't appear dark brown at all.

Yes, he does have several shades of colors throughout his tail including some darker browns.

If these are true black hairs what color would Saber be?

I would say your boy is a sorrel pinto. The reason is, I have had a couple mares color tested for the same reason you have stated here. They were what I had always considered as sorrels, but they also seemed to have some black hairs in their manes and tails, so I suspected they must be silver bays. NOT...both tested that they were red, but carried agouti.
 
It is not uncommon at all for chestnuts to have black hairs here and there.
